How to restrict how your confidential health records are used for research and planning purposes

There are two NHS data controls that allow patients to restrict how their confidential health records are used for research and planning. Neither option prevents your personal medical data from being used by clinicians for your direct personal care.

Type 1 Opt-Out

A Type 1 Opt-out stops your GP practice from sharing your confidential patient information with NHS England (or previously NHS Digital) for research and medical planning.

  • Scope: Applies specifically to your GP medical records.
  • How to apply: You must request this directly from your GP surgery.

National Data Opt-Out

The National Data Opt-out prevents NHS England from sharing your confidential patient information (from both GP practices and hospitals) with outside organisations (like universities, charities, and private companies) for research and planning purposes.

  • Scope: Covers the broader health and care system across England, including hospital and GP records.
  • Exemptions: It does not apply if you have consented to a specific study, or if the data is anonymised so that you cannot be identified.
  • How to apply: You can manage this digitally via Your NHS Data Matters, the NHS App, or by calling 0300 303 5678.

Summary of Differences

While both target secondary uses of your data, the Type 1 Opt-out specifically blocks GP data from leaving your local practice, whereas the National Data Opt-out allows your data to be collected centrally but blocks NHS England from sharing it onwards for research.
